1. Entry: You must be 21 years of age or older to be eligible
for this contest. Contest begins December 14, 2003, and ends January
31, 2004 unless earlier terminated by Secrets of Home Theater
and High Fidelity (SECRETS) as set forth in these Official Rules.
Enter online, complete the official entry form located on the SECRETS
registration page on www.hometheaterhifi.com. You will be asked to
provide your email address and to provide information about your home
theater/audio interests.
LIMIT ONE ENTRY PER PERSON
No responsibility is assumed by Secrets of Home Theater and High
Fidelity for lost or late entries or for any computer, online,
telephone or technical malfunctions that may occur. Email entries will
be declared made by the authorized account holder of the email address
submitted at the time of entry. "Authorized account holder" is defined
as the natural person who is assigned to an email address by an
Internet Access provider, on-line service provider or other
organization (e.g., business, educational institution, etc.) that is
responsible for assigning email addresses for the domain associated
with the submitted email address. All entries become the property of
Secrets of Home Theater and High Fidelity and will not be returned to
entrant. Winning entrants will be requested to provide Secrets of Home
Theater and High Fidelity with proof that the potential winner is the
authorized account holder of the email address associated with the
winning entry.
2. Winner Selection: Prize Winners will be selected in
random drawings to be held weekly on Monday of each week beginning
December 22, 2003. Winners will be notified by email within 2 days of
selection. If winner is unreachable after 5 days or if winner is
unavailable for prize fulfillment, an alternate winner will be
selected at random from all remaining eligible entries received.
3. Prizes: Prizes are described on the prize page for
this contest at www.hometheaterhifi.com. Prizes will be chosen
randomly, with a minimum of 2 prizes chosen each week of the contest.
4. Eligibility: This Contest is open to legal residents of the
United States and Canada, who are 21 years or older at the time of entry. The
Contest is void where prohibited, restricted or taxed by law.
Employees of Secrets of Home Theater and High Fidelity and its
affiliates, advertising and promotional agencies and prize suppliers
and the immediate family members (including those living in the same
household) of each such employee are not eligible.
5. General Conditions: Contest entrants agree to abide by the
terms of these Official Rules and by the decisions of the judging
organization which are final on all matters pertaining to Contest.
This Contest is governed by the laws of the United States. All
federal, state and local laws and regulations apply and all entries
must comply therewith. All taxes, fees and surcharges on prizes are
the sole responsibility of the prize winner. Return of any prize/prize
notification as undeliverable may result in disqualification and
selection of an alternate winner.
Acceptance of a prize constitutes permission for Secrets of Home
Theater and High Fidelity to obtain winners name and address for
purposes of shipping the prize to winner and to publish winner’s
proper name as a winner on the SECRETS website without additional
compensation unless prohibited by law. Each entrant agrees that
Secrets of Home Theater and High Fidelity may use the information
disclosed by entrant, subject to Secrets’ then-current privacy policy,
for any commercial purpose, including the delivery of promotional
emails. By entering, each and every entrant releases and holds
harmless each of Secrets of Home Theater and High Fidelity and its
affiliates, directors, officers, employees, representatives and agents
from any and all liability for any injuries, loss or damage of any
kind, including but not limited to personal injury or tangible or
intangible property damage, arising from or in connection with the
Contest or any prize won. Each entrant is subject to and agrees to be
bound by all restrictions, conditions and limitations set forth
herein.
6. Conduct: By entering this Contest, you agree to be
bound by these Official Rules. The Official Rules will be posted at
the Contest Site throughout the Contest. Entrants further agree to be
bound by the decisions of the judging organization, which shall be
final and binding in all respects. Secrets of Home Theater and High
Fidelity reserves the right at its sole discretion to disqualify any
individual it finds to be tampering with the entry process or the
operation of the Contest or Contest Site, acting in violation of the
Official Rules or acting in an unsportsmanlike or disruptive manner or
with intent to annoy, abuse, threaten or harass any other person.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO
DELIBERATELY DAMAGE ANY WEBSITE, INCLUDING BUT NOT LIMITED TO THE
CONTEST SITE, OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST
IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT
BE MADE, SECRETS OF HOME THEATER AND HIGH FIDELITY, INC. RESERVES THE
RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT
PERMITTED BY LAW.
7. Limitations of Liability: Secrets of Home Theater and
High Fidelity will not be responsible for any incorrect or inaccurate
information, whether caused by Contest Site users or by any of the
equipment or programming associated with or utilized in the Contest or
by any technical or human error which may occur in the processing of
submissions in the Contest. With respect to the Contest and any and
all entries therein, Secrets of Home Theater and High Fidelity does
not assume any responsibility for any error, omission, interruption,
deletion, defect, delay in operation or transmission, communications
line failure or any theft or destruction of, unauthorized access to or
alteration of entries. With respect to the Contest and any and all
entries therein, Secrets of Home Theater and High Fidelity will not be
responsible for any problems, technical malfunction or failure of any
telephone network or lines, computer online systems, servers or
providers, computer equipment, software or email on account of
technical problems or traffic congestion on the Internet or at any
website or combination thereof, including injury or damage to entries,
entrants or any other person or to any entrant’s or other person's
computer related to or resulting from participating or downloading
materials in this Contest. If, for any reason, the Contest is not
capable of running as planned, including due to infection by any
computer virus, bugs, tampering, unauthorized intervention, fraud,
technical failures or any other causes beyond the control of Secrets
of Home Theater and High Fidelity which corrupt or affect the
administration, security, fairness, integrity or proper conduct of
this Contest, Secrets of Home Theater and High Fidelity reserves the
right at its sole discretion to cancel, terminate, modify or suspend
the Contest.

OR FITNESS FOR A PARTICULAR PURPOSE.
IN NO EVENT SHALL SECRETS OF HOME THEATER AND HIGH FIDELITY BE
RESPONSIBLE HEREUNDER FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL OR
INDIRECT DAMAGES INCURRED BY ANY ENTRANT OR ANY THIRD PARTY EVEN IF
SECRETS OF HOME THEATER AND HIGH FIDELITY HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.
